Sales terms and conditions
These terms cover any and all sales agreed upon between the company called “Data Vitae” or the “seller” and either an individual or an entity wishing to purchase via the Data Vitae website, referred to as the “buyer” or the “client”.
Data Vitae is located 33, avenue du Général de Gaulle, F-74200 Thonon-les-Bains and registered at the Chambre des Métiers et de l’Artisanat de Haute-Savoie with the number 529795999.
By purchasing goods via the Data Vitae website the client agrees that he has read these terms and understands them and agrees to be legally bound by them.
These terms overwrite any other conditions.
Data Vitae has the right to modify those terms at any given time. In that case the valid terms will be those in place the day of the purchase order.
The products offered are those listed in the published catalog on the Data Vitae website.
They are provided according to their supply availability.
Actual products may differ from the pictures.
The prices listed in the catalog include added value taxes. These prices are valid for France and the European Community members. Any changes in the tax will involve a change of price.
For any other countries, the invoiced price will not include the value added tax. The buyer will be responsible to pay the value added tax and any delivery or custom fees valid in his or her country.
Data Vitae has the right to modify those prices at any given time. In that case the valid prices will be those in place the day of the purchase order.
The prices do not include the handling and shipping fees.
The buyer has to:
Create a new account or sign in as a member
Select a product, write and save the text that you want us to engrave according to the instructions (number of lines and characters), select a size, place order
Check and validate the shipping and invoice addresses
Accept the sales terms
Make the payment
Confirm the order and the payment
By confirming the order, you the buyer agree that you have read these terms, understand them and agree to be legally bound by them.
Data Vitae will confirm by email receiving the order.
Data Vitae has the right to refuse the order if the text to be engraved is against public policy and good morals.
Without giving any reason you may withdraw from the contract in writing (e.g. by letter or by email) or by sending the goods back within 7 days after receipt of non personalized products. The withdrawal shall be addressed to Data Vitae 33, avenue du Général de Gaulle, F-74200 Thonon-les-Bains.
No Right of withdrawal for personalized products
However it should be noted that statutory right of withdrawal does not apply if goods were individually personalized based on customer’s instructions or needs.
Any type of engraving implies individually personalized product.
The price must be paid in full when ordering.
Data Vitae accepts credit cards, wire transfer, cheques (bank located in France) and Paypal.
IBAN Nr: FR76 1382 5002 0008 0050 2482 879.
For credit card payment, Data Vitae uses the Systempay security payment of the Caisse d’Epargne.
An invoice will be available in the client account on the Data Vitae website.
Order and handling process
The client’s order will be processed once the payment has been accepted (cashed in cheques for the cheque payment).
The handling process of that order will require a maximum of 4 working days unless specified otherwise by Data Vitae (vacation, out of stock or any other reasons).
Data Vitae will use the shipping address provided by the client while ordering on the website. In the case of mistakes or change in that address Data Vitae is not responsible for not being able to deliver the ordered products.
Given shipping times are only an estimation and are not guaranteed.
Any delay doesn’t allow the client to cancel the order or refuse the merchandise nor does it imply reimbursement or indemnification.
Shipping time should be added to the handling process.
All products sold by Data Vitae are under the legal warranty according to the article 1641 of the French Civil Code.
In case of hidden defects or lack of conformity of the sold product only, Data Vitae will replace or reimburse the product.
All claim should be done by mail at the following address within 30 days after receiving the goods : Data Vitae 33, avenue du Général de Gaulle, F-74200 Thonon-les-Bains.
The reimbursement of the returned items will be done by Data Vitae at the same price and using the same method of payments than the purchase of the products.
Any returned item that will be incomplete, damaged or dirty will not be accepted, replaced nor reimbursed.
The company Data Vitae personalizes objects through engraving according to the data provided by the client. Data Vitae doesn’t check these data and therefore cannot be responsible for their content, their veracity or their usage and non-usage.
Handling and use of personal data and cookies
- Personal data
The personal data that the seller will ask the buyer are useful for the processing of the order.
Data Vitae will not hand over those data to anyone. They are only available to authorized personnel in charge of the order process.
Only the email address of the buyer will be used by an evaluation collector, Trusted Shops, to ask the buyer via an email to assess his shopping experience (product/delivery/customerservice).
The Trusted Shops Trustbadge is integrated on the Data Vitae website in order to display the clients’ feedback.
The Trustbadge and the advertised trust badge services are offered by Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne, Germany.
With every use of the Trustbadge, the web server automatically saves a so-called server log file which contains e.g. the IP address, the date and time of the request, the volume of data transferred and the requesting provider (access data), and documents the request. Those access data are not analysed and are automatically overwritten no later than seven days after the end of your website visit.
Other personal data are transferred to Trusted Shops only if the client decides to use or has already registered to use Trusted Shops products after placing an order. In such a case, the contract concluded between the buyer and Trusted Shops applies.
The specific data collected for the engraving of the products the client has bought are only used for this purpose. They are also only available to authorized personnel in charge of the order process. Those data are regularly erased.<
In accordance with the French Data Privacy law of January 6, 1978, as amended by the law of August 6, 2004, the collection and processing of your personal data via the Website have been declared to the CNIL and you have a right of access, modification and deletion of the processing of your personal data.

As recommended by the CNIL : « In accordance with the French data protection and civil liberties statute (Loi Informatique et Libertés), the cookies or other technologies requesting the buyer’s consent can’t be used on his terminal, as long as the buyer hasn’t given his consent » and the visitors « must have the possibility to choose not be traced while they navigate on a website or use an application ».
The activation of cookies takes place when the visitor click on the « I accept » button on the hereafter alert banner. The consent of the internaut is valid during one year so as not to ask him again each time he uses Data Vitae’s website.

In case of unforeseen events and force majeure (including strikes) Data Vitae will no longer be bound by any obligation towards its clients.
All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Data Vitae.
No one is authorized to reproduce or use or broadcast or link any part of this site without written consent by Data Vitae.
Data Vitae’s trademark and logo have been registered.
Any copy, partial or total, of this logo is forbidden without Data Vitae’s authorization.

In accordance with the French Data Privacy law of January 6, 1978, as amended by the law of August 6, 2004, the collection and processing of the client's personal data via the Website have been declared to the CNIL (declaration number 1483938) and the client has a right of access, modification and deletion of the processing of his personal data.
The data provided by the buyer for the personalization/engraving of the products will be used only for this purpose. They will not be kept.
Filing – proof
Data Vitae will save orders and invoices on a trustworthy backup so as to have a faithful copy in accordance with the French Civil Code 1348 clause.
The Data Vitae computer records will be considered by both parties involved as a proof of the communications, orders, payments and transactions between them.
These online sales terms are subject to the French law.
In case of dispute, the seller and the buyer will try and resolve the matter amicably, notably through to Juri Mediation, a French association located in Pringi (74).
If the mediation doesn't succed, competence falls within the juridiction of the Thonon-les-Bains Commercial Court.
